Addressing Unum Insurance Lawsuits

Several clients have contacted our New York and New Jersey disability lawyers about lawsuits against Unum insurance, claiming that the company unfairly denied them disability benefits that were rightfully theirs. Long-term disability insurance helps employees who cannot work after an injury or illness by financially supplementing their income, even if the cause is not work-related. An employee usually pays a subsidized amount for the coverage.

Claim Denials And Questionable Practices

As the largest insurance provider of its type in the U.S., the long-term disability company, previously called Unum Provident and First Unum, has insured an estimated 17 million people across the nation. They have reportedly denied thousands of insurance claims during the past two decades. They have supposedly used some of the following questionable tactics when denying claims:

  • Partial payment of an initial claim but later denying the same claim.
  • Improper claim investigation tactics and relying on opinions from “experts” who are not qualified
  • Denying a claim despite a lack of medical evidence or
  • Excessive requests for additional medical examinations.

If you believe that you have been subject to any of these unfair tactics by Unum or another long-term disability insurance provider, contact our New Jersey disability attorneys for help.

The Case Of Sarah S.

In an example of a Unum insurance disability lawsuit, Unum denied Sarah S., the plaintiff, long-term disability benefits. She previously worked for a food service company and was diagnosed with an unspecified disability that reportedly kept her from working. Although she could not maintain employment, her claim was reportedly denied, according to the lawsuit. She alleged that the denial was based on incorrect expert opinions and on biased information instead of on the substantial evidence that she provided to Unum.

Although she went through the administrative protocol for resolving the dispute, including appealing the denial, Unum had not given her solid reasons for their refusal or any further benefits. The Unum disability lawsuit also alleges that the company improperly made claim decisions because of a serious conflict of interest in the case that negatively affected their decision. In addition to previously denied benefits, Sarah’s lawsuit is requesting legal fees and related court costs, under the Employee Retirement Income Security Act of 1974.

Lawsuits Against Unum Insurance Company

Due to their alleged track record of denying valid disability claims, Unum and the subsidiary companies, including Colonial Life & Accident Insurance Company, the Paul Revere Life Insurance Company and Provident Life, have been named in various claim denial lawsuits across the nation. Policyholders have charged the company with bad faith practices in the disability insurance lawsuit claims.
