Denial of Life Insurance Claims

  • Cause of death — UQUR represented the family of a man who had high altitude pulmonary edema, a rare medical condition, who died of a seizure aboard a plane. His policy covered only death by "natural causes," but the insurer determined the cause was "accidental death" brought on by high altitude. After our legal research proved that this precise issue had been decided against the carrier in a similar case in California, the insurer paid the claim.
  • Incontestability — The insurer may terminate claims because of omitted facts or misstated information on their application for insurance. We argue incontestability if information was provided in good faith and the carrier continued to collect premiums for several years without noticing the errors. The insurer must prove intentional fraud to cancel coverage.
  • Pre-existing Conditions — The insurer may argue that the deceased concealed a medical condition to qualify for coverage. UQUR has had success with the counter-argument of post-claim underwriting: that the insurance carrier gladly took the victim's premiums without checking available data, and only scrutinized medical information after a claim was filed.
